On 22 November 2016, the Court of Cassation upheld the decision of the Basse-Terre Court of Appeal of 13 October 2015 ordering the company Eaux de Capes Dolé to pay a fine of €50,000 for deception.

The latter judgment states that "[i]t is an offence of deception to market, under the name 'spring water', water taken from the natural environment that has been treated to eliminate pesticides from human pollution, whereas the regulations adopted for the application of Article R.1321-85 of the Public Health Code concerning spring water only authorise treatments relating to the separation of unstable elements or undesirable constituents from such water".
