On 17 February 2023, the organisations filed a complaint against the California Department of Pesticide Regulation (hereinafter DPR), which is responsible for regulating the use of pesticides in California, for exempting crop seeds treated with pesticides from regulation.

While the DPR is required to take all measures that are "necessary to protect the environment" under Food and Agricultural Code (FAC) ยง 14102, it fails to monitor whether the pesticides used to coat seeds are registered.

For example, in the California territory, at least seventeen pesticide active ingredients that are not registered are used on treated seeds. Furthermore, some of these active ingredients used to coat seeds are not registered in any state in the United States.

The applicants therefore consider that the DPR has failed to comply with its environmental and health protection obligations by failing to regulate pesticide-coated seeds.
