Herbicide contamination is retained. Canteen Bonacchi must change the way he sprays. Canteen Bonacchi must bear the costs, including those of the summary proceedings and compensate the professional prejudice suffered by the plaintiff.

The plaintiff wants his neighbour, Canteen Bonacchi, to stop spraying pesticides on the vineyard near his property because of the contamination he suffered, which resulted in copper levels (4.23 mg/kg) exceeding regulatory standards. In 2011, he obtained an interim injunction ordering Canteen Bonacchi to change the way his vineyard was sprayed in order to stop this contamination.
