Abrogation of the Executive Decision from May 4, 2017 on the marketing and use of phytopharmaceutical products and their adjuvants.
Conseil d'Etat of Paris, France

June 26, 2019
Partially Positive
The Council of State partially revokes the decree because it does not sufficiently protect public health and the environment.

Request for the abrogation of the Executive decision of May 4, 2017 on the marketing and use of phytopharmaceutical products and their adjuvants because it does not take into account the scientific knowledge of the dangers to human health of the pesticides, notably for neighbours, in allowing spraying too close to sensitive areas and not protecting neighbours against pesticides. The actions were filed by Générations Futures and Eau et Rivières de Bretagne on behalf of Solidaires trade union, Collectif Vigilance OGM Pesticides 16 under the impetus of Collectif de Soutien aux victimes des pesticides de l'Ouest. On 6/5/2019, the public rapporteur requested the annulment of the executive decision "insofar as it did not include provisions to protect residents of areas treated with plant protection products". The Council of State cancels parts of the decision because it is not protective enough for public health and the environment on June 26.
