To cancel for excess of power the implicit decision to reject the request to take implementing measures in transposition of Directive 2009/128/EC establishing a framework for Community action to achieve a sustainable use of pesticides, i.e. to ban or restrict the use of synthetic pesticides in Natura 2000 sites.

The Council of State asks the government to take the useful and necessary measures to protect biodiversity of European interest exposed to pesticides in Natura 2000 areas within six months.

FNE groups have noted in the field the lack of implementation of the French law transposing the European directive which requires Member States to ban or restrict the use of synthetic pesticides in Natura 2000 sites and have filed a complaint with the Council of State. The latter noted the illegality of this situation, and ordered the government to take the necessary measures to protect biodiversity of European interest exposed to pesticides in Natura 2000 terrestrial areas within six months.
