The applications of the Union des industries de la protection des plantes, the Association générale des producteurs de blé et autres céréales, the Association générale des producteurs de maïs, the Confédération générale des planteurs de betteraves and the Fédération nationale des producteurs de fruits are rejected.

Decree No. 2018-675 of July 30, 2018, by which France bans the use of five active substances from the neonicotinoid family: acetamiprid, clothianidin, imidacloprid, thiacloprid, thiamethoxam, is being challenged by the Union of Plant Protection Industries (UIPP) and producer organizations. They ask the Council of State to suspend the execution of the decree of July 30, 2018 and to cancel it.

On October 29, 2018, the request to suspend the execution of the decree was rejected by the Council of State (No. 424627). On the merits of the case, i.e., the action for annulment, the Conseil d'Etat stayed its ruling on June 28, 2019 (no. 424617) until the Court of Justice of the European Union answers the preliminary questions posed in this case (see the summary of Case C-514/19 for more details on the preliminary reference).

By a decision of July 12, 2021, the Council of State rejected the action for annulment. The prohibition of these substances does not impinge on the competence of the European Commission to approve active substances and does not infringe the provisions relating to the granting and withdrawal of marketing authorizations for plant protection products and the placing on the market of seeds treated with such products.
