Name of the Court : Supreme Court of Buenos Aires, Argentina Jurisdiction level : No description Summary : On September 15, 2023, the Rural Entities Liaison Commission ("Comisión de Enlace de Entidades Agropecuarias, CEEA"), an inter-union organization defending the rights of Argentine agricultural producers, asked the Supreme Court to annul on grounds of unconstitutionality Law n°VIII-103 banning the use of products containing glyphosate by 2025, passed last June by the province of Misiones. CEEA argues that the ban on all use of glyphosate is unconstitutional because the sale and use of glyphosate is authorized throughout the country by the competent national authorities. Consequently, the provincial law would violate the numerous federal regulations governing and organizing the use of glyphosate-based products, namely Decrees no. 3489/58 and 5769/59, the declaration of national interest law on vegetable and animal health, and regulations issued by national health authorities.
