Cancel the order of February 5, 2021 provisionally authorizing the use of sugar beet seeds treated with plant protection products containing the active substances imidacloprid or thiamethoxam, granting a marketing authorization for the plant protection product "CRUISER SB" for a period of 120 days; order the State to pay the applicants the sum of €2,000 each.
Administrative Court of Toulouse, France

7 groups file an appeal for cancellation against the order of February 5, 2021 re-authorizing neonicotinoids for seed protection in beet crops. In spite of an action by Members of Parliament before the Constitutional Council, law n° 2020-1578 relating to the conditions of marketing of some plant protection products in case of sanitary risk for sugar beet was adopted on December 14, 2020 and the order of application on February 5, 2021. The appeal is coupled with a demand for summary judgment. The administrative court of Toulouse was chosen because Syngenta, the producer of the offending products has its headquarters in the Department.
