Name of the Court : U.S. District Court for the Eastern District of New York, United States Jurisdiction level : Summary : On September 27, 2023, the U.S. Department of Justice (DOJ) filed a claim on behalf of the Environmental Protection Agency (EPA) against U.S. online selling platform eBay. The DOJ accuses eBay of violating several regulations relating to air quality (Clean Air Act, CAA), pesticides (Federal Insecticide, Fungicide, and Rodenticide Act, FIFRA) and toxic substances (Toxic Substances Control Act, TSCA). The DOJ has accused eBay of allowing the sale and distribution of over 23,000 pesticides banned or restricted in the United States. Aware of the problem for several years, the EPA has ordered eBay to halt the sale and distribution of these products in 2020 and 2021. In response to the DOJ's complaint, eBay said it was removing almost all of the products cited by the DOJ, and working "closely with law enforcement [...] to identify emerging risks and assist with prevention and enforcement," the online retailer wrote."
