Legal basis : No description Court Ruling : No description Summary : On September 28, 2023, the 21st Judicial Circuit of Missouri for Saint Louis County granted Monsanto's request for a directed verdict in a dispute with Mark Mc Costlin, an individual who developed non-Hodgkin's lymphoma in 2017 after using Roundup in his garden between 1985 and 2014. A directed verdict is a judgment that rules in favor of the defendant, after the plaintiff has presented evidence, but before the defendant has presented arguments. Such a verdict is rendered when the judge concludes that the plaintiff has not presented the minimum evidence necessary for a reasonable jury to find in his favor. In this case, Monsanto argued that the plaintiff had failed to present evidence that would allow a reasonable jury to determine that McCostlin's use of Roundup was the cause of his non-Hodgkin's lymphoma. This request for a directed verdict was part of the case of Barbara Allegrezza et al. v. Monsanto Company, a complaint filed by more than 90 people suffering from non-Hodgkin's lymphoma as a result of their exposure to Roundup. As a result of this decision, the jury, which should have been responsible for the verdict in this case, was dismissed. The plaintiff has decided to appeal this decision.
