The plaintiffs, two Maui families who lived near Monsanto's fields in Kihei, were exposed to the drift of many pesticides that are used in the cultivation of genetically modified crops. They became seriously and permanently ill. They filed a lawsuit in the 2nd Court of Appeals against Bayer, the company that bought Monsanto, and landowner Alexander & Baldwin, alleging that the pesticides and chemicals used in the fields caused birth defects in their children.
