The trial court granted a directed verdict in favour of defendants because the activity was not considered ultra dangerous and the defendants were not negligent. This was confirmed by the Supreme Court on November 11, 2004.

Plaintiff alleges that Ron Moss, flying for Marshall's Flying Service, had negligently sprayed an ultra-hazardous chemical, Roundup Ultra, onto the land of Ronald Pigue on May 10, 1997, so that it drifted on to his land, destroying his corn crop. The 1st instance trial court granted a directed verdict in favor of defendants, as the activity was not considered as ultra-hazardous and defendants have shown no negligence. This has been confirmed by the Supreme Court on Nov. 11, 2004.
