Name of the Court : General Court of the European Union of Luxembourg, European Union Jurisdiction level : First instance Summary : In a press release of December 20, 2023, the NGO coalition PAN Europe announced its intention to file two complaints with the General Court of the European Union. One of these is an action for annulment of Regulation (EU) 2023/574 adopted on March 13, 2023 by the European Commission, detailing the rules applicable to the identification of unacceptable co-formulants in plant protection products. PAN Europe complains that the regulation does not sufficiently regulate the use of co-formulants, which make pesticides more dangerous. In particular, there is no obligation for manufacturers to provide the European authorities with data on the co-formulants used. PAN Europe also points out that the European Food Safety Authority itself has acknowledged that no information exists for more than half of all co-formulants. PAN Europe therefore calls for the toxicity of co-formulants, whether resulting from the product alone or from interactions between co-formulants and the active substance, to be taken into account in legislation and in the authorization process for pesticide products, on the basis of the precautionary principle.
