Name of the Court : No description Jurisdiction level : No description Summary : On December 13, 2023, several environmental NGOs and groups representing farmers submitted a petition to the Environmental Protection Agency (EPA) calling for the immediate suspension and cancellation of all registrations for glyphosate-based crop protection products. All claim that the registration of glyphosate-based products fails to meet the safety requirements detailed in the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). To obtain registration, FIFRA requires the EPA to determine that there are no unreasonable environmental effects associated with its use, for the entire duration of the registration. In view of glyphosate's particularly harmful effects on human health and the environment, the petitioners, who rely on over 200 scientific studies (the most recent of which dates from December 6, 2023) argue that glyphosate poses unacceptable risks to the environment and human health, particularly for farmers and others directly exposed to the product. The petition follows a ruling by the Ninth Circuit Court of Appeals in San Francisco (No. 20-70787) that glyphosate's 2020 registration violated the Endangered Species Act (ESA), and that the carcinogenic risks of the substance had not been adequately considered. If the EPA fails to act on the petition, or if the response is unfavorable, the petitioners have announced their intention to file a lawsuit in the U.S. courts.
